1. Purpose of the Policy
The School of Business and Management (SBM) is committed to ensuring compliance with the UK Copyright, Designs and Patents Act 1988, the Licensing Terms of the Copyright Licensing Agency (CLA), and other applicable intellectual property laws.
This policy establishes guidelines for the lawful use of copyrighted materials when using photocopiers, scanners, and printers within the institution.
2. Legal Framework
This policy is based on the following UK laws and regulations:
- Copyright, Designs and Patents Act 1988 – Protects the rights of authors, publishers, and copyright owners.
- Copyright Licensing Agency (CLA) Licence – Permits limited copying of copyrighted materials for educational purposes.
- Intellectual Property Office (IPO) Guidelines – Outlines fair dealing provisions and permitted usage of copyrighted materials.
Failure to comply with copyright laws can result in legal consequences, including fines and institutional liability.
3. Scope of the Policy
This policy applies to:
- All staff, faculty, students, and visitors using SBM’s photocopiers, scanners, and printers.
- All printed, scanned, or copied materials, including books, journals, articles, and digital content.
This policy applies to all photocopying and digital reproduction carried out within SBM premises, including:
- Library facilities
- Faculty and administrative offices
- Student resource centers
4. Copyright Notice Requirements
4.1 Placement of Notices
- Copyright notices must be displayed next to all photocopiers, scanners, and printers in the institution.
- Notices must be clearly visible, legible, and written in simple language.
- The notice must include legal references to the Copyright Act and the CLA Licence.
4.2 Standard Copyright Notice Text
All photocopiers and printers at SBM must display the following notice:
COPYRIGHT NOTICE
WARNING: COPYING AND PRINTING RESTRICTIONS APPLY
Under the Copyright, Designs and Patents Act 1988, it is illegal to copy, scan, or print copyrighted materials without permission.
The Copyright Licensing Agency (CLA) Licence allows limited copying of materials for educational purposes only.
You may only copy:
- Up to 5% or one chapter of a book (whichever is greater).
- Up to one article from a journal issue
- Up to one short story or poem (not exceeding 10 pages) from an anthology.
- Only for personal study, teaching, or research purposes.
Unlawful copying or distribution of copyrighted materials may result in disciplinary action and legal penalties.
If you are unsure about copyright limits, please seek advice from the Library Staff or Academic Office.
5. Responsibilities of Users
5.1 Staff & Faculty Responsibilities
- Ensure compliance with copyright laws when distributing materials to students.
- Use officially licensed educational resources whenever possible.
- Advise students on copyright restrictions in coursework and research.
5.2 Student Responsibilities
- Copy only within legal limits (e.g., up to 5% of a book).
- Do not distribute or share copied materials for commercial purposes.
- Seek permission from faculty or librarians if unsure about copyright restrictions.
5.3 Library & IT Department Responsibilities
- Display copyright notices near all photocopiers, printers, and scanners.
- Monitor excessive copying or unauthorized printing.
- Provide guidance to students and staff regarding copyright laws.
6. Enforcement & Penalties
- Unlawful copying or distribution of copyrighted materials will result in disciplinary action, which may include:
o Written warnings for minor infractions.
o Revocation of printing and copying privileges for repeated offenses.
o Formal disciplinary action, including suspension for serious violations. - Legal consequences: Unauthorized reproduction of copyrighted content may lead to fines or legal action against the individual or institution.
7. Exceptions & Special Permissions
- The Copyright, Designs and Patents Act 1988 allows limited exceptions under the fair dealing principle, including:
o Quoting or referencing short excerpts for academic criticism, research, or review.
o Disability exceptions allowing text-to-speech software for visually impaired users.
o Official licensing agreements between SBM and publishers for extended use.
If special permissions are required, users should seek approval from the Academic Office or Library Services.
8. Policy Review & Updates
- This policy will be reviewed annually by the Academic Board to ensure compliance with UK copyright laws and CLA licensing requirements.
- Updates will be communicated to staff and students through official notices, emails, and training sessions.
9. Compliance Statement
All users of SBM’s photocopiers, printers, and scanners are expected to adhere strictly to copyright laws. Any misuse or unauthorized reproduction of copyrighted materials will not be tolerated.
